  • Multidisciplinary work in Energy Law, with an emphasis on Regulatory, Tax, Corporate and Civil Law, working on the preparation of Opinions, Technical Notes, Memoranda, Contracts, Initial Petitions, Defenses, Administrative and Judicial Appeals, as well as other legal documents related to the matters, with a view to mitigating legal and regulatory risks;
  • We work in regulatory consultancy and litigation with energy regulatory agencies (ANEEL, ANP), in all its stages (Generation, Distribution and Commercialization);
  • Filing, defending and monitoring legal-administrative claims with the National Electric Energy Agency (ANEEL), especially with regard to Administrative Proceedings brought by the Regulatory Agency as a result of periodic and extraordinary inspections, the Ministry of Mines and Energy (MME), the National System Operator (ONS), the Electricity Trading Chamber (CCEE), the Energy Research Company (EPE), the Securities and Exchange Commission (CVM), the Federal, State and Municipal Revenues, the Taxpayers Council (CC), the Administrative Council for Tax Appeals (CARF), among others;
  • Consultancy for consumers (free or captive), self-producers, independent producers, traders, distributors, transmitters and generators of electricity in view of the frequent legislative changes that impact the electricity sector, assessing, from a legal standpoint, the risks, opportunities and consequences for agents operating in this segment, including distributed micro and mini-generation;
  • Analysis and legal-regulatory support in the signing of typical contracts in the electricity sector, including: Energy Commercialization Contract in the Regulated Environment (CCEAR); Electricity Purchase and Sale Contract in the Free Environment (CCVEE) for Conventional, Incentivized and Alternative sources; Guarantee Constitution Contract (CCG); Assignment Terms and Amendment Terms; Connection and Use Contracts for the Distribution and Transmission Systems (CCD, CCT, CUSD and CUST); Intermediation and Representation Contract (brokerage), among others;
  • Assistance and monitoring, from a legal-regulatory point of view, of Periodic and Extraordinary Tariff Reviews and Adjustments triggered by ANEEL, in which the agent is a party to the process or a third party affected by the effects of the decision approved by the Agency, with a view to preparing contributions and appeals to mitigate the losses or increase the benefits received; and
  • Legal advice, both consultative and contentious, on the ICMS tax levied on activities related to the generation, distribution and transmission of electricity; the IPTU tax levied on company assets; other taxes levied on the regulated service, such as TFDR, ITCD, ISS; the Special Regimes relevant to electricity operations; as well as environmental taxes and contributions.
